The Wicked — Terms of Service

1. Acceptance of Terms

By creating an account, using, or accessing any service offered by The Wicked, you agree to abide by these Terms of Service. If you do not agree, do not register or use our services.

2. User-Generated Content Policy

Users are fully responsible for all content they upload, share, or distribute through their bio pages and profiles. We do not pre-screen content and cannot be held responsible for user-submitted content.

Prohibited Content Includes (but is not limited to):

• Illegal activity or promotion of such
• Harassment, hate speech, discrimination
• Sexually explicit or adult content
• Spam, scams, phishing links
• Malware, viruses, harmful software
• Impersonation or fraudulent behavior
• Promotion of self-harm or violence

2.1 Prohibited Graphic Content

The Wicked strictly prohibits the upload, sharing, or distribution of any content that contains:

• Gore, extreme violence, or mutilation
• Sexually explicit material, nudity, or pornography
• Any imagery or media deemed offensive, obscene, or inappropriate for a general audience

Accounts found hosting such content will be subject to immediate removal, termination, and potential blacklisting. This includes profile pictures, backgrounds, audio, videos, or linked content.

3. Account Termination

We reserve the right to suspend, terminate, or ban any user without notice for violating these terms, engaging in illegal activity, or harming the platform or community in any way.

4. Refund Policy

All payments made to The Wicked are final and non-refundable. By purchasing any service or feature, you agree that no chargebacks, refunds, or returns will be issued, unless required by law.

5. Limitation of Liability

The Wicked, its developers, and owners cannot be held liable for any damages, losses, or legal consequences arising from user-generated content or misuse of the site.

6. User Responsibility

• You are responsible for keeping your account secure.
• Do not share your login credentials.
• You are fully responsible for any content or actions associated with your account.

7. Registration Codes & Access

Some registrations may require a code provided directly by staff. Unauthorized sharing, selling, or trading of registration codes is prohibited.

8. Modifications

We reserve the right to update, modify, or change these Terms of Service at any time without prior notice. Continued use of the site means you accept any changes made.

9. Governing Law

This agreement is governed by the laws of the United States. Any legal disputes will be resolved in a court of competent jurisdiction within our operating state.

11. Privacy & Data Storage

We value user privacy and do not sell, share, or distribute your personal data. The only information we store is the data you provide within the platform (such as your username, profile content, links, and theme settings). We do not track or log any activity outside of what is necessary to operate your account and services. By using The Wicked, you consent to this minimal data collection.

12. No Warranties

The Wicked is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the reliability, availability, or accuracy of the services. Use of the platform is at your own risk.

13. Digital Product Nature

All services and features provided by The Wicked are considered digital goods. By purchasing, you acknowledge that these goods are intangible and are not subject to return, refund, or resale outside of our platform.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Wicked, its developers, staff, and affiliates from any claims, damages, losses, or legal fees resulting from your use or misuse of the platform, your violation of these terms, or your infringement of any rights of another party.

15. Age Requirement

By using The Wicked, you confirm that you are at least 13 years old or meet the minimum age required by your jurisdiction. If you are under the age of majority, you must have parental permission to use the site.

16. DMCA Compliance

If you believe that content hosted on The Wicked infringes your copyright, you may submit a DMCA takedown request. We will act in accordance with the Digital Millennium Copyright Act (DMCA) and promptly remove infringing content when notified.

17. Service Availability

We strive to maintain uninterrupted access to The Wicked, but we do not guarantee continuous operation. Temporary outages, maintenance, or technical issues may occur, and we are not liable for any impact caused by downtime or feature unavailability.

18. Enforcement & Reporting Violations

We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates these Terms. Users can report abuse or violations by submitting a support ticket via our Discord server or official contact channels.

19. Third-Party Services

The Wicked may integrate or link to third-party services (e.g., payment processors, communication tools). We are not responsible for the terms, policies, or availability of any third-party services, and your interactions with them are at your own risk.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the rest, and the remaining Terms will continue in full force and effect.

21. Entire Agreement

These Terms of Service constitute the entire agreement between you and The Wicked regarding the use of our services and supersede any prior agreements, communications, or understandings.

22. No Guarantee of Results

The Wicked does not guarantee any specific outcomes, results, or improvements from using the site, features, or services. Results may vary per user and depend on individual usage.

23. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our control, including natural disasters, acts of war, terrorism, governmental restrictions, internet failures, or other events outside of our reasonable control.

24. Discord Bot Services

The Wicked offers a Discord bot ("TheWicked") that integrates with Discord servers. By using or adding this bot to a Discord server:

• You acknowledge the bot operates under Discord's Terms of Service and API guidelines
• Server administrators are responsible for configuring the bot appropriately for their community
• We are not responsible for any moderation actions, messages, or automated responses generated by the bot
• The bot may collect server data (channel IDs, role IDs, user IDs) solely for functionality purposes
• We do not store message content beyond what is necessary for specific features (e.g., ticket transcripts)
• Bot features may change, be modified, or discontinued at any time without notice

24.1 VRC 18+ Verification Bot Terms

The Wicked also provides a dedicated VRC 18+ Verification Bot. By inviting, configuring, or using this service, you agree to the following service-specific terms:

• Only server owners or authorized administrators may configure verification, log, and role settings
• You are responsible for running setup commands (including /setup) with correct channels and role selections
• You agree to grant only the permissions required for operation, including channel-level permissions defined in our setup guide
• You are responsible for your server's moderation outcomes and any role grants issued from your configuration choices
• You must not use the bot for harassment, targeting, intimidation, or abuse of users who appear in verification channels or logs
• We may restrict access, disable service, or deny onboarding for any server that violates these Terms or platform safety rules

24.2 Verification Scope and Transparency

• The VRC 18+ flow is intended to verify eligibility for server access based on bot checks and configured rules; it is not a government identity service or legal age certification
• Verification outcomes may be displayed in designated transparency/log channels to show that the system is active and functioning
• Public log entries are limited to information necessary for verification transparency and moderation context
• You are responsible for your own server disclosure, privacy, and moderation policies when enabling transparency channels
• No verification method is perfect; you accept the risk of false positives, false negatives, and service/API dependency limitations

24.3 Data Used by VRC 18+ Verification Features

For VRC 18+ verification functionality, we may process and store limited operational data such as:

• Discord identifiers (e.g., user ID, server ID, channel ID, role ID)
• VRChat identifiers and profile references required for verification workflows
• Verification status records, timestamps, and setup configuration values
• Support/ticket context and limited audit logs needed to resolve disputes or abuse reports

This data is used for core bot operation, abuse prevention, support handling, and service integrity. We do not sell verification data. Data retention may vary based on operational, safety, and legal requirements.

25. Virtual Economy & Digital Currency

Some services may include virtual economies, currencies, or point systems. By participating:

• Virtual currency has no real-world monetary value and cannot be exchanged for real money
• Virtual currency and items are non-transferable outside the platform unless explicitly allowed
• We reserve the right to modify, reset, or remove virtual currency balances at any time
• Exploitation, cheating, or abuse of economy systems may result in account termination
• We are not responsible for any perceived "loss" of virtual items or currency

26. Third-Party API Data

The Wicked integrates with third-party APIs (including but not limited to TrackerNetwork, Discord, and Spotify) to provide features such as game statistics and account linking. By using these features:

• Data retrieved from third-party APIs is provided "as-is" and we make no guarantees of accuracy
• We are not responsible for the availability, accuracy, or timeliness of third-party data
• Third-party services may change or discontinue their APIs, affecting our features
• Your use of linked accounts is subject to those platforms' respective terms and policies
• We do not control or guarantee the security of third-party platforms

27. OAuth & Account Linking

When you link external accounts (Discord, Spotify, etc.) through OAuth:

• We only request permissions necessary for our services to function
• Access tokens are stored securely and encrypted
• You may revoke access at any time through the respective platform's settings
• We are not responsible for any actions taken using linked account data
• Account linking is voluntary and optional for most features

28. Automated Systems & Moderation

The Wicked uses automated systems for moderation, spam detection, and content filtering:

• Automated systems may make errors; we are not liable for false positives or missed violations
• Users may appeal automated actions through our support channels
• Server administrators configure their own moderation rules and thresholds
• We are not responsible for moderation decisions made by server administrators

29. Ticket & Support Systems

When using ticket or support features:

• Ticket conversations may be logged for quality assurance and dispute resolution
• Do not share sensitive personal information (passwords, financial data) in tickets
• We are not responsible for information shared in tickets by users
• Ticket data may be retained for a reasonable period after resolution

30. Beta Features & Testing

Some features may be offered in beta or testing phases:

• Beta features are provided "as-is" with no warranty
• Beta features may be unstable, incomplete, or contain bugs
• We may discontinue or significantly modify beta features at any time
• Participation in beta testing is voluntary and at your own risk

31. Data Accuracy Disclaimer

While we strive for accuracy, we make no guarantees regarding:

• Game statistics, leaderboards, or player data
• Server configurations or settings synchronization
• Real-time data updates or refresh rates
• Historical data preservation or availability

Users should not rely on our services for critical decisions or official records.

32. Compliance Notice

We strive to comply with applicable laws and regulations, including:

• GDPR (for EU users) — see our Privacy Policy
• CCPA (for California residents)
• COPPA (Children's Online Privacy Protection Act)
• Discord's Developer Terms of Service and Community Guidelines

If you believe we are not compliant, please contact us immediately.

33. No Professional Advice

Nothing on The Wicked constitutes legal, financial, medical, or professional advice. All content and services are for entertainment and informational purposes only.

34. Nyx Marketplace

Nyx is a marketplace where users ("Sellers") may list items for sale and other users ("Buyers") may purchase them. Your use of Nyx is subject to these Terms in full, plus the additional terms in this section.

• Except where The Wicked is expressly identified as the Seller, we are a venue, not a party to the transaction. The contract of sale is between the Buyer and the Seller.
• We do not pre-screen listings. We do not guarantee the quality, safety, legality, or existence of anything listed.
• An account in good standing is required to buy or sell. Marketplace access may be suspended independently of the rest of your account.
• We may remove any listing, cancel any transaction, or suspend marketplace access at our discretion, including where we suspect fraud or a breach of these Terms.
• Items sold directly by The Wicked (such as Premium) are sold by us, and Sections 4 and 13 apply to them.

35. Selling on Nyx

By listing an item you agree to the following. These obligations are yours alone, and we do not assume them on your behalf.

• Payouts. Sellers are paid through Stripe Connect. You must complete Stripe's onboarding, including identity and bank details, before your listings can be purchased. Your relationship with Stripe is governed by the Stripe Connected Account Agreement, which you enter into directly with Stripe.
• Platform fee. We retain a commission on each completed sale, shown to you before you list and on each order. The remainder is transferred to your connected Stripe account. We do not hold your funds; the split happens at the moment of payment.
• Fee changes. We may change the commission rate on notice. The rate recorded against an order at the time of sale is the rate that applies to it.
• Delivery. We do not host or deliver Seller goods. You are responsible for delivering what you sold, promptly, using the order's message thread or another method you arrange with the Buyer.
• Accuracy. Listings must accurately describe what is being sold. Misleading titles, images, or descriptions are a breach of these Terms.
• Rights. You warrant that you own or are licensed to sell everything you list, and that the sale does not infringe anyone's intellectual property or other rights.
• Prohibited items. You may not list: anything unlawful; stolen, hacked, or fraudulently obtained accounts, goods, or data; malware, cheats, or tools intended to compromise systems; personal data belonging to others; weapons, drugs, or regulated goods; sexual content involving minors or non-consenting persons; or anything otherwise prohibited by Section 2.
• Taxes. You are solely responsible for determining, reporting, and paying any tax arising from your sales. We do not provide tax advice and do not withhold or remit tax on your behalf.
• Chargebacks and refunds. You are responsible for refunds, chargebacks, and disputes arising from your sales, including any amounts reversed after payout. We may recover such amounts from your future sales or require repayment.
• Independence. Nothing here creates an employment, agency, partnership, or joint venture relationship between you and The Wicked.

36. Buying on Nyx

• Payment is processed by Stripe. We never receive or store your full card details.
• Except where The Wicked is the Seller, you are contracting with the Seller. Any dispute about the item is between you and them in the first instance.
• Sellers deliver their own goods. Delivery times, formats, and support are set by the Seller, not by us.
• Purchases of digital goods are generally final. Where a Seller offers a refund policy, that policy is the Seller's to honour.
• Raising a chargeback without first attempting to resolve the matter with the Seller and with us may result in suspension of your account.
• We may, but are not obliged to, intervene in disputes. Any action we take is at our discretion and does not create an obligation to do so again.

37. Marketplace Messaging

A private message thread is opened between Buyer and Seller when an order is paid. It exists so goods can be delivered and questions answered.

• Messages are stored on our servers and are not end-to-end encrypted. Staff may access them where necessary to investigate a dispute, a report, or a suspected breach of these Terms.
• Do not share passwords, card numbers, or other sensitive credentials in messages. We will never ask for them.
• Harassment, spam, scams, and attempts to move a transaction off-platform to avoid fees or protections are prohibited.
• Agreements made outside the message thread cannot be verified by us and will carry little weight in any dispute.

38. Arbitration & Dispute Resolution

Any disputes arising from these Terms or use of our services shall first be addressed through informal negotiation. If unresolved after 30 days, disputes may proceed to binding arbitration in accordance with applicable law. You waive any right to participate in class-action lawsuits against The Wicked.

39. Survival

Sections regarding limitation of liability, indemnification, disclaimers, and dispute resolution shall survive any termination of these Terms or your account.
